1. Application and Account Details

1.1 You can place orders with BOW WOW online at www.bowwowshop.ie
1.2 Access to the online shopping with us will require user registration. You can use the quick shopping option where you will register as a guest and be provided just with a reference number. For subsequent access you will be asked to create an account that you will use by logging in with your email address and password. We advise you to register to save time, for fast and easy check out, to store multiple shipping addresses, and for easy access to your order history and status. The information you provide must be accurate and complete.
1.3 Importance of email
For any type of shopping (as a guest or registered customer) you must have an active email address (one that you habitually use). When you give us your email address, we will email you as necessary to process your order, confirm your returns, recall products, respond to a request, and provide customer service. All Password Details are accepted and may be withdrawn at our sole discretion and are exclusive to you and non-transferable.
We may also send promotional emails about products, special offers, services or events we believe may be of interest to you. It is our intention to send promotional emails only to those who wish to receive them. Just let us know that you want to unsubscribe by email.

1.4 If you register as a guest to use this publication and create an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occurs under your account or password. You must inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.
1.5 If you are under 18, you may use bowwowshop.ie only with the involvement of a parent or guardian. BOW WOW reserves the right to refuse to supply any individual or company, to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
1.6 If you do not want your name and mailing details made available, no longer want to receive advertisements or wish to alert us to duplicate mailings, please email us at [email protected] BOW WOW is committed to respecting your privacy. An electronic copy of each order is held by BOW WOW but will not be accessible to you.
1.7 All orders will be concluded in the English language. We can deal with you in Russian and Lithuanian languages; you just have to inform us about requested language by sending us e-mail.
1.8 You agree that we may use Personal information provided by you in order to conduct appropriate anti-fraud checks.
1.9 We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website. Your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

2. Use of the BOW WOW website / Intellectual Property



2.1 You must not misuse the website by knowingly adding, altering, corrupting or erasing data (introducing viruses) or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. This applies to hackers in Ireland accessing a computer in Ireland or elsewhere, or hackers who access data within Ireland from abroad.
2.2 Unauthorized access and extracting of info from BOW WOW databases is prohibited.
2.3 Any person who dishonestly whether within or outside the state operates or causes to be operated a computer within the state with the intention of making a gain for himself or another, or of causing loss to another (BOW WOW) is guilty of a crime / offence.
2.4 Breaching these provisions amount to a criminal offence under the Criminal Damage Act 1991, Data Protection Acts 1988 and 2003, Copyright and Related Rights Act 2000, Criminal Justice (Theft and Fraud Offences) Act 2001. We will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
2.5 BOW WOW accept no liability to any person for any loss or damage (e.g. to computers or other devices) suffered as a result of viruses or other harmful content accessed from or via our website. We do our best to ensure that the website is free from viruses and other harmful content. It is your responsibility to ensure that you have the right equipment and antivirus software to use this website safely.
2.6 We have placed links on our website to other websites we think you may want to visit. We are not responsible for the content and activity of these websites and we will not be responsible for any offence, damage or loss caused to you by using such websites.
2.7 You agree that all intellectual property rights contained in all material or content supplied or made available on the BOW WOW website is owned or licensed by BOW WOW and is protected by copyright law. You may use, print and download content on the website only for your own personal, non-commercial use.

3. Product and Service Descriptions



We have taken reasonable steps to display as accurately as possible all our products. We are constantly working to improve the photos on our website. However, BOW WOW does not guarantee that product descriptions or other content of this site is accurate, complete, current, or error-free. When ordering products through the website, please note that:
• Packaging may vary from that shown on the website;
• The actual colors and detailing you see onscreen will depend on the equipment you use to view the products. We cannot guarantee that your device (television, mobile phone, computer or other) will accurately reflect the color and detailing of the product delivered.
• The weights, measurements, sizes, dimensions and capacities shown on the website are approximate only;
• If we notice that a product description is wrong, your order will be cancelled, even if it has been initially confirmed;
• We would like to inform you that if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially confirmed;
• The products, services and promotions which are offered on the BOW WOW Website may not be available in-store and vice-versa;
• Always read product you get manual (instruction manual, information on the packaging), information on the Website is only informative and not full, please take it seriously and do not leave products and/or parcels you get from BOW WOW unattended, keep out of the reach of children and pets, until you find that it is safe to leave product unsupervised with children or pets. Some of our products are created for pets and can be left with pets without supervision, but some of our products contain sharp elements (fishing hooks), some liquids and other products using in fishing and the pet industry can be dangerous to your child or pet, if not used correctly, many products manufactured for pets can be used only under adult supervision. If you are not sure about the safety of a product, please contact us before using it.
If a product offered by BOW WOW itself is not as described, your sole remedy is to return it in unused condition. Please see our Returns & Exchanges Policy - Section 10 & 11.

4. Placing an Order/Acceptance of Your Order

4.1 All orders submitted by you are an offer to purchase and are subject to acceptance by us.
4.2 Before submitting your order online, in the “Order Review” step you have the chance to check all the details of your order again (billing and shipping addresses, shipping and payment methods, products details) and make changes if necessary. If you click on “Edit your Card” in the left-hand corner of the last step of the ordering process (“Order Review” process) you can continue your shopping, update or clear your shopping cart. This will also show you the subtotal amount you have to pay for goods, estimated shipping and handling charges and total amount (it can vary depending on accuracy of delivery charges). By clicking on the button “Proceed to Checkout” you can go back to your shopping checkout and place your order by clicking on the button “Place Order”.
4.3 Once you have gone through the ordering process you make a binding offer to purchase the goods from BOW WOW by clicking on the button “Place Order”. After placing an order you can see on your screen your order number and you can print a copy of your order by clicking on the hyperlinked section “here to print”. Please keep your order number (reference number) and copy of your order for future reference.
4.4 Please note – completion of the online checkout process does not constitute our acceptance of your order. Your order is accepted and the contract is thereby concluded by dispatching the goods you ordered. The contract is therefore concluded when the goods you ordered are dispatched.
4.5 The details of your order are electronically stored and you will get a Confirmation email from us shortly after placing an order with all the relevant details of your order, which you can then print out directly. Please keep your order Confirmation email in a safe place for future reference with your Policy Terms and Conditions. This confirmation email does not constitute our acceptance of your order. We may change shipping and handling charges because you only get an estimated quote when you place an order online. The delivery charges we quote online do not usually change. Once your package ships we will send a follow-up email with a link to track your order and inform you about any changes of your delivery charges that may occur. If we are unable to contact you we will treat the order as cancelled. If order is cancelled but you have already paid for the goods, you will receive a full refund.
4.6 We may choose, at our sole discretion, not to accept your order for any reason without liability to you. There are many different reasons for our decision not to accept an order, for example: product is not in stock or incorrectly priced or described; wrong delivery address; we cannot obtain authorization of your payment; it is an age – restricted product (see section 4.8 below) and many other reasons.
4.7 If you order a product, to which a minimum age requirement applies, by ordering that product you confirm that you and the recipient (if different) of the product are of the required age necessary to buy that product. If we reasonably believe that you are not legally entitled to order a product, we reserve the right to cancel your order.

5. Availability



5.1 Please note that we will honour your order within the limits of our available stock. In the event that any of the products ordered are not available in our inventory, you will be notified via email of any changes to your order availability. If you have already paid for the products, we will give you a full refund, as soon as reasonably possible, being no more than 30 days from the date on which your order was cancelled. To the best of our ability, we will inform you of when you can expect your item, as you may keep or cancel your order.
5.2 If there are certain products that are temporarily unavailable, we will send the available products and will refund the shipping fees, if they change, for the rest of the order.

6. Pricing



6.1 The prices indicated on the site are in Euros and include all taxes but do not include delivery charges. The total cost for the Delivery Service will be itemized and identified on the payment screen and in your Confirmation and Delivery emails. We reserve the right to modify our prices at any time but will apply the current rates as indicated to you on the site at the time the order was placed.
6.2 Promotions and discounts are subject to additional terms and conditions. If you are supplied with a promotion code for a discounted product, please check the applicable terms and conditions. Promotional codes are usually displayed on our Offer or Facebook page, via email or press marketing.
6.3 Please note that we do not accept gift vouchers bought in store for payment on goods purchased on our website, unless stated otherwise (information must be on voucher). Please ask in store, if you have any questions.
6.4 For products reserved online for store pick up or any other reservation service, the price you pay is the price in store on the day of collection, unless stated otherwise.
6.4 We would like to inform you that if an obviously incorrect price or/and discount appears on our website (a price that is clearly too low, or discount is too high for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially confirmed. We will inform you as soon as possible about order cancellations in our follow-up email and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If order is cancelled but you have already paid for the goods, you will receive a full refund.
6.5 Please note that in some countries outside of the EU you will be responsible for payment of additional import duties and taxes payable to the local tax authorities on receipt of your delivery.
6.6 Please note that we cannot take responsibility for additional processing, administration and exchange rate charges that you may be liable to pay to Your International credit/debit card provider or bank.

7. Waitlist



There are products that are currently out of stock and only available to order using our Waitlist service. This option is perfect for customers ordering made to measure, expensive or bulky products, that we do not have or keep only a few in stock and where the possibility that we may run out of stock is high (expensive fishing reels, aquariums, dog kennels, for example). After placing an order we will contact you as soon as possible and inform you about your approximate delivery date. You have to pay for Waitlist items in full. If stock does not arrive within the next 30 days, unless different terms are agreed, we will contact you via e-mail and we reserve the right to cancel your order and give you a full refund. If we are unable to contact you we will treat the order as cancelled. If an order is cancelled but you have already paid for the goods, you will receive a full refund. Please be aware that the cancellation rights of EU consumers under the Directive do not apply to certain products and services (See section 10. Returns and Cancellation), in this case you will get your money back if we fail to supply your product under the agreed terms.
If we decide that a product can be put on our Waitlist it means the supplier of this product is reliable and we can get it back in stock soon, in many cases it’s just one day in addition to your normal delivery (delivery of product in stock) date. The customers who ordered first will receive their products first. This option is perfect for shop collection, if you want to save money on our delivery service.

8. Payment

8.1 Payment can be made by most major credit or debit cards. We cannot accept cash.
8.2 You agree to allow BOW WOW to retain and use your credit or debit card details for any subsequent purchases made by you with us.
8.3 We take payment from your card at the time we receive your order, once we have checked your card details. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
8.4 By accepting these terms and conditions you allow us to check your credit/debit/charge card details and disclose it to a registered Credit Reference Agency which may keep a record of this information. We will validate name, address and other personal information supplied by you against appropriate third party databases. This is done only to confirm your identity; credit rating and credit check is not performed. All information provided by you will be treated securely and strictly in accordance with the Data Protection Acts 1988 and 2003.

 

9. Delivery/Delays



9.1 We deliver within Ireland at the moment. If you want your order to be delivered to any other destinations please request this in writing.
9.2 Orders will be sent to the delivery address that you have provided in your online order form. We cannot be held responsible if that delivery address is incorrect or incomplete.
9.3 Please note that delivery address and your billing address can be different.
9.4 There are restrictions on the locations to which BOW WOW can deliver products. We reserve the right to define what can and cannot be delivered to which destination. We are unable to accept orders for delivery to any address containing a PO Box Number.
9.5 Prices and timescales may vary depending on the types of products ordered, delivery service selected and your delivery address.
9.6 BOW WOW does everything in its power to respect the delivery times indicated on the website. We cannot, however, be held responsible for any loss or damage (whether direct or indirect) of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event. In the event where you do not receive your package in the indicated time frame, an investigation will be conducted with the carrier and may take several days upon receipt of your claim. During this period, no reimbursement or re-delivery will take place. 

Upon receipt of your order, we recommend that you verify your products against the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it.
9.7 At the time of delivery you will be required to validly sign-off on the delivery of the products and the products ordered will become your property (provided they have been paid for in full) after which time the products become your sole responsibility. Risk of loss and damage of products passes to you upon delivery.
9.8 We accept no liability if delivery is not made due to the recipient not being available or having entered an incorrect name. The goods will be returned to us and a charge will be made for re-delivery to that or an alternative address.
9.9 In the event that you select a business address for delivery we shall be deemed to have delivered the order to its intended recipient by delivering it to the reception area of the business address.
9.10 We will deliver to the address as you enter it and cannot accept any liability for late or failed delivery if the quoted address is incorrect. Additional charges will be made for redirection or for re-delivery due to address or postcode error.

10. Returns & Cancellation

If you change your mind and would like to return your product, we are happy to refund it. We will refund the purchase price and refund the original postage amount for the product you want to return. However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if you decide to cancel your order and we require you to pay for the cost of returning the item.

10.1 Your right to cancel the order starts the moment you place your order and does not end until 7 working days from the day after you receive your goods. Working days means all days other than Saturday, Sunday and public holidays.
10.2 You must inform us in writing by email or post (find our contact details below) within 7 working days from the day after the date on which the product is delivered. You should keep evidence of having given your cancellation notice. Your cancellation notice must quote the reason you are returning the item (just write cancel) your name, address, the name or a description of the product and your order reference number. Please remember that you must keep proof of purchase (receipt, delivery note, bank statement) as well.
10.3 You must return any cancelled products either to our store or ship it to BOW WOW (find our contact details below) promptly after you get a confirmation e-mail from us. If a product is returned without prior written authorization from BOW WOW, it will be automatically sent back to you at your expense.
10.4 You are liable for any return shipping costs.
10.5 Please note that if returned products are lost or damaged in transit we are under no obligation to offer you any type of compensation and reserve the right to charge and reclaim from you amounts related to such loss or damage. For this reason, we recommend that you use a recorded delivery service (with signature on receipt) and for all returns please obtain a receipt of proof of postage as if your products do not reach us You will get Your money back from delivery company and you have proof that you send your products.
10.6 The product must be in 'as new' condition and returned in the original, undamaged packaging along with any accessories and free gifts received with it. Whilst the goods are in your possession you must take reasonable care of them and not use them.
10.7 Please be aware that the cancellation rights of EU consumers under the Directive do not apply to certain products and services:
• A. Perishable products such as food or plants (for example aquarium plants, worms);
• Audio/video recordings, DVDs or computer software that you have taken out of the sealed packaging in which they were delivered to you;
• Made to measure orders (for example aquariums made to your own specification, vet bedding that we sell by the meter);
• Magazines and any other products that by reason of their nature cannot be returned.
10.8 Once we receive the item(s) we will issue a refund - returning item(s) price and delivery charge for the item you want to return, and send you an e-mail confirmation. However, we do have the right to retain any charge paid for services that have already begun or have been completed.
10.9 If your refund is approved, we will process it within 30 days from the day we receive the notice of cancellation, provided that you have returned products to us in their original condition.
10.10 We will normally refund you using the same payment method that you used to purchase the product. Refunds will only be made against the original credit/debit card used. 

10.11 Please note that we cannot accept returned goods that we reasonably believe have been used or damaged. In such circumstances, we will notify you that no refund will be available and you will be responsible for arranging for such goods to be returned to you within 30 days of our notification.

11. Faulty/Damaged or Incorrectly Supplied Products

Where delivered goods turn out to be faulty, damaged, incorrectly supplied and where you are not to blame we will refund the purchase price, original delivery charge for product you want to cancel and refund the return postage amount, as long as a receipt for this has been included. Alternatively we can replace the product with the same, or a similar product (subject to stock availability). However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if we deliver faulty, damaged or wrong products.

11.1 You should check all products you receive against your parcel summary to confirm that you have received everything you ordered. If the products you receive are damaged or incorrect then you must note the details of any damage or error in supply on the parcel summary.
11.2 You must inform us in writing by e-mail or post of any damage or error as soon as possible (find our contact details below). You should keep evidence of having given your return notice. We will not accept the return of any damaged or incorrectly supplied products where you fail to notify us of this within a reasonable period of time. Please remember that you must keep proof of purchase (receipt, delivery note, bank statement). In your return notice you must explain what the problem is, quote your name, e-mail, address, the name or a description of the goods and order reference number.
11.3 You must return any cancelled products to BOW WOW promptly after you get a confirmation e-mail from us. If a product is returned without prior written authorization from BOW WOW, it will be automatically sent back to you at your expense. After receiving a confirmation letter you can also bring your faulty, damaged or incorrectly supplied product into our store (find our contact details below) with proof of purchase and we will process an exchange or refund for you. To ensure we have your product in stock, please call ahead to confirm availability.
11.4 Please note that if returned products are lost or damaged in transit we are under no obligation to offer you any type of compensation and reserve the right to charge and reclaim from you amounts related to such loss or damage. For this reason, we recommend that you use a recorded delivery service (with signature on receipt) and for all returns please obtain a receipt of proof of postage as if your products do not reach us you will get your money back from delivery company and you have proof that you send your product.
11.5 We reserve the right to refuse to issue a refund/replacement product and to recover the cost of the return delivery from you in the event that the product is found to have suffered damage after delivery to you or has been misused or used other than in accordance with the instructions or if the problem is due to normal wear and tear. The goods must be in 'as received' condition and returned in the original, undamaged packaging along with accessories and free gifts received with it. Whilst the goods are in your possession you must take reasonable care of them and not use them.
11.6 Once we receive the item(s) we will process the exchange, issue a refund - refunding item(s) price, original delivery charge for the item you want to return and refund the return postage amount, as long as a receipt for this has been included and send you an e-mail confirmation. However, we do have the right to retain any charge paid for services that have already begun or have been completed.
11.7 We will normally refund you using the same payment method that you used to purchase the product. Please allow 30 days from the day we receive the notice of cancellation, for your refund to be processed or a replacement product to be dispatched, provided that you have returned products to us.

12. Guarantees



A guarantee is a document from the manufacturer confirming that they will repair or replace an item if something goes wrong within a certain amount of time after you buy it. Please check the instruction or user manual you will get with the product, you may need to register the guarantee with the manufacturer for certain conditions to be met and find out exactly what is covered by the guarantee.
